Privacy Policy
[EDIT: draft. Have a Florida attorney review this page, the consent wording and the lead-sharing flow (TCPA, FCC 24-17, Fla. Stat. 501.059 and 934.03) before launch.]
Effective date: [EDIT: effective date] · Operated by [EDIT: legal entity name, e.g. XYZ Marketing LLC] doing business as "SwFl Ductless Pros"
1. Information we collect
- What you give us in the quote form: number of rooms, ZIP code, whether you own the home, timeline, name, phone number, email, and any notes.
- Consent records: the exact consent wording you agreed to, the time, the page URL, and your IP address and browser details. We keep these to prove consent under the TCPA.
- Calls and texts: if you talk to us or our AI phone assistant, we may keep call recordings, transcripts, summaries and text messages (see section 4).
- Automatic data: basic analytics and ad data, such as pages viewed, referring ad or UTM tags, device and approximate location. [EDIT: list analytics/ad tools in use, e.g. Google Analytics, Meta Pixel, or remove if none]
2. How we use it
- To check whether your ZIP is in our service area and match you with a suitable installer.
- To call, text or email you about your quote request and appointment, including confirmations and reminders.
- To keep records, prevent fraud and spam, comply with the law, and improve our service.
3. Who we share it with
- Your matched installer partner. When you request a quote, online or by phone, we share your contact details, address, your answers (rooms, ZIP, homeowner status, timeline, current system, budget or financing interest), your appointment, and a copy of your consent record with the independent, licensed installer partner matched to your request. Where we have a current installation partner, we name them in the consent box and on the phone ("our partner installer(s)"). That installer runs the free in-home quote and any work. They may use your information under their own privacy policy.
- Service providers who help us run the service, such as hosting, scheduling, phone/SMS, email and AI voice providers, under contracts that limit how they use your data. [EDIT: e.g. Twilio, Cal.com, Resend, xAI]
- Legal reasons: when the law requires it, or to protect rights and safety.
We may be paid by the installer for the referral (see our Terms). We do not sell or rent your personal information to data brokers, lead resellers or anyone other than the installer partner matched to your request.
Your call and text consent covers the matched installer
The consent you give (the two optional boxes on our quote form, or your spoken "yes" when our AI assistant reads the same wording on the phone) lets SwFl Ductless Pros and the named or matched installer partner call and text you at the number you provided about your quote request, including with automated technology and an AI (artificial-voice) assistant, for things like the call recap, appointment confirmations, reminders and a short automated reminder call. Sharing your details with the installer and calls and texts are two separate choices, online and on the phone, so you can say yes to one and no to the other. Without the sharing consent we don't pass your request to an installer, and we only reply by email.
- Consent is not required to buy anything. You can request a quote by calling us instead.
- We pass your number and consent record only to that matched installer, so they can contact you about this request. We never share mobile numbers or text-message opt-in data with anyone else, including affiliates, for their own marketing.
- Text STOP to us or to the installer at any time. A STOP or do-not-call request to either of us is passed to the other.
4. Calls, AI assistant and recordings
Some calls and texts from us are handled by an AI (artificial-voice) assistant named Jordan. It says it's an AI assistant at the start of every call. Calls may be recorded and transcribed for quality, to keep records and to produce appointment summaries. A summary of a reminder call (and, where we have arranged it with them, the transcript) may be shared with your matched installer so they know whether you confirmed, rescheduled or cancelled. Florida requires all parties to consent to recording, so we tell you at the start of the call. If you don't want to be recorded, say so and the call will end, or ask for a person.
5. Your choices
- Text STOP to any message (ours or the installer's) to stop texts. Say "stop calling" on a call, or email us, to stop calls.
- Ask us to access, correct or delete your information: [EDIT: privacy contact email]. We'll pass deletion and opt-out requests to the installer we shared your data with. They also hold their own copy under their own policy.
6. Retention and security
We keep lead and consent records for up to [EDIT: e.g. 5] years, because TCPA claims can be brought up to 4 years later. We keep call recordings for [EDIT: e.g. 12 months], then delete them unless we need them for a dispute. We use reasonable safeguards, but no system is perfectly secure.
7. Other
This site is for adults in Florida and isn't directed to children under 13. We may update this policy and will change the effective date when we do.
